Terms of Use

 

Although you may browse this web site freely, you may choose to become a registered user of the website.  You can do this by accepting the terms of use of this forum and registering below.

You are only permitted to use the forum for personal, non-commercial purposes. If you are under the age of 18 you should seek your parents' permission before accessing the forum. Because users can automatically make postings, they may contain content which is not appropriate for people under 18.

Postings


By becoming a registered user, you may wish to contribute "postings" (meaning any content whatsoever contributed by a user to the community). Although we,  Manchester United Supporters Club (Malta), don't monitor every single posting, we do drop in to see what's going on. We reserve the right to review and delete any messages, including their content, any photos or profiles that in our sole judgment violate this Agreement or which might be offensive, illegal, or that might violate the rights of other registered users, or otherwise harm or threaten their safety.  It is possible that other users of the website or users (including unauthorized users, or hackers) may post or transmit offensive, obscene or pornographic materials on the Website and that you may be involuntarily exposed to such offensive, obscene or pornographic materials. While we do not, and cannot, review every message or other material posted or sent by users of the forum, and are not responsible for any content of these messages or materials, we will delete, move, or edit messages or materials, including, without limitation, profiles, public postings, messages, video and audio recordings that we, in our sole and absolute discretion, deem to violate the purpose for which this Website was created, or which we deem to be otherwise unacceptable or undesirable.

The following is a partial list of the type of messages, whisper messages, photos or profiles (hereinafter collectively referred to as ‘Material’), that is illegal and/or prohibited on the web site: -

-    Material which expresses or implies that any statements you make, are in effect made or endorsed by us;

-    Material which is patently offensive to the online community, such as Material that promotes racism, hatred or physical harm of any kind against any group or individual;
 
-    Material that harasses or advocates harassment of another person ;

-    Material that involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
-    Material that promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
-    Material that promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
-    Material which contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);  
-    Material which displays pornographic or sexually explicit material of any kind;  
-    Material which exploits people under the age of eighteen (18) years in a sexual or violent manner, or solicits personal information from anyone under eighteen (18) years of age ;
-    Material which provides instructional information about illegal activities including, but not limited to, making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses ;  
-    Material which solicits passwords or personally- identifying information for commercial or unlawful purposes from other users ;
-    Material which engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

You shall remain solely responsible for the content of profiles, public postings, messages, video and audio recordings and other materials you may upload to the forum or transmit to users of the forum.

User name


Do not create a user name (handle) that:

-    contains racist, sexist or homophobic words;
-    contains defamatory statements or personal attacks on others;
-    are made under another person's name or impersonating another person;
-    contain commercial advertising;
-    contain excessively coarse language or content; or

This criteria also pertains to content contained in your profile.

Some general terms


•    If you're relying on information or opinions from postings, remember you do so at your own risk. Be aware that postings only represent the opinions and experience of users, not ours.
•    If you want to copy, amend or re transmit others' postings, you need permission. Permission can be obtained from the user or from us.
•    By registering, submitting postings, or emailing us, you will be supplying us with "personal information". We collect this to administer and help you use the services, send you a password, contact you about postings, and keep in touch with you.
•    Your user name will be visible to other users, and when you register for the forum, you can chose whether your user profile and email address will be also be visible to other users.
•    If you make postings which are in breach of these terms or the law, we may choose to pass your details and IP address on to an aggrieved person, or a law enforcement agency.
•    The copyright in your postings is yours (generally speaking). We may, at our discretion, use postings in our publications (books, newsletters, websites, radio and television programs and other products in any media). You give us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide licence to reproduce, communicate, re-publish, edit, adapt or otherwise use your postings as we see fit, including the right to sublicense to others at our discretion. You also give us a licence to deal with the postings as necessary to perform technical and administrative functions in running the forums.
•    You may also have moral rights, so you consent to your postings being altered, edited or adapted to use them under our licence in any way we see fit. You consent to us not attributing authorship to you at all, or only attributing it to your registered 'handle'. We generally attribute authorship, but that's not always possible and we decide this on a case by case basis. If we do use your material we may attribute it to your registered 'handle', or contact you to request that your real name be used. We will never publish your real name without permission.
•    If you don't want your posting to be used in this way, don't post it. Once you have made a posting, you can't withdraw or retract your licence and consents.
•    Illegal and/or unauthorized uses of the website, including collecting usernames and/or email addresses of other registered users by electronic or other means for any reason, including that of sending unsolicited email and unauthorized framing of or linking to the Website, will result in cancellation of your registration as a registered user of the web site and being reported to the competent authorities.
•    We reserve the right to terminate your registration as a registered user of the web site for any activity which we deem to effect, in any way, the enjoyment of the Website or the Internet by others and for which we hold you to be responsible.
•    We cannot ensure the security or privacy of information you provide through the Internet and your email messages, and you release us from any and all liability in connection with the use of such information by other parties.
•    We are not responsible for, and cannot control, the use by others of any information which you provide to them and you should use caution in selecting the personal information you provide to others through the Forum.
•    We cannot assume any responsibility for the content of messages sent by other users of the Service, and you release us from any and all liability in connection with the contents of any communications you may receive from other users.
•    We cannot guarantee, and assume no responsibility for verifying, the accuracy of the information provided by other users of the Service.
•    We are not responsible to you or anyone else for any loss, damage, liability, cost or expense suffered in connection with the use of the forum or any of its content or services. We make no warranties or representations about the online community or its content and exclude, to the maximum extent permitted by law, any liability which may arise as a result of the use of the forum or its contents. We will never be liable for any indirect, incidental, special or consequential loss, or loss of business profits or revenue arising out of the use of the forum or its contents. You indemnify the Manchester United Supporters Club (Malta) against each claim, action, proceeding, judgment, damage, loss, expense or liability incurred or suffered by, or brought, made or recovered against us in connection with any breach by you of these terms of use.

Disputes


You are solely responsible for your interactions with our other registered users on the web site. We reserve the right, but have no obligation, to monitor disputes between you and other users. If a dispute arises between users of the community, or between users and a third party, Manchester United Supporters Club (Malta) is not, and will not be, obliged to get involved.

This Agreement is entered into in the Republic of Malta (Europe) and you agree that it will be governed by the laws of the Republic of Malta (Europe) and any disputes arising out of this Agreement will be interpreted according to Maltese Law and will be subject to the exclusive jurisdiction of the Maltese Courts.

If any provision in this Agreement is invalid or unenforceable under the applicable law, the remaining provisions will continue in full force and effect.

By accepting these terms of use you are also accepting the legal statement of this web site.
